Terms of Service

MI HOME ENERGY Installation & Service Agreement This Installation and Service Agreement (the “Agreement”) is made and entered into on the Date of Service, by and between MI HOME ENERGY LLC, with a principal place of business at Chesterfield, MI, and the Home Owner, residing at the service address provided by the Home Owner .

1. Scope of Work The Company agrees to provide and install a home energy monitoring system, Smart Thermostat or Smart Sprinkler Controller from a Third Party Provider (the “System”) at the Customer’s property provided by the customer.

The service includes the following: Supply and installation of all necessary hardware components. Configuration of the System to connect to the Customer’s internet network. Setup of the Manufacturer’s mobile application or online portal for The Customer. A brief overview or training on how to use the System and its features.

2. Customer Responsibilities and Access,

The Customer agrees to the following:

Access: Grant the Company, its employees, and authorized subcontractors access to the property to perform the installation and any necessary maintenance or repairs.

Power and Connectivity: Ensure continuous and stable power and internet connectivity (Wi-Fi) are available for the System’s operation. The Company is not responsible for service interruptions caused by internet or power outages.

Permits: Obtain any necessary permits or approvals from the property owner, homeowner’s association, or local municipality.

System Integrity: Not alter, modify, or tamper with the System, or allow any unauthorized party to do so.

3. Equipment Ownership and Warranty Equipment Ownership: The Customer assumes ownership of the installed System hardware upon final payment.

Warranty: The Company warrants its workmanship for 12 months following the installation. Manufacturer warranties for all hardware components will be passed on to the Customer. The warranty does not cover damage caused by misuse, neglect, or acts of nature.

4. Data Collection and Privacy Data Collection: Data Collection is provided by the equipment manufacturer and the customer consents to the manufacturer’s term of service during the installation of the Manufacturer’s mobile application. The Customer will provide this data to the The Company via email and The Company will use this data to provide the monitoring service and may use aggregated, anonymized data for product improvement and marketing purposes.

Privacy: The Company agrees to protect the Customer’s personal information and energy data in accordance with its Privacy Policy.

Data Access: The Customer will provide The Company with data as they deem necessary.

5. Limitation of Liability and Indemnification Limitation of Liability: The Company’s liability for any and all claims, whether arising from contract, tort, or otherwise, is limited to the total fees paid by the Customer to the Company under this Agreement. The Company is not liable for any indirect, incidental, or consequential damages.

No Insurance: The Company is not an insurer of the Customer’s energy consumption or efficiency. The System is a monitoring tool and is not guaranteed to reduce the Customer’s utility bills.

Governing Law This Agreement shall be governed by and construed in accordance with the laws of the Michigan.

6. Entire Agreement This Agreement, including all exhibits, constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral.
